We bot on our machines every day and cannot reproduce this issue.

You can try the following steps:
1. Use the latest bot version 0.9.295
2. Go to Settings >Loot>Right bottom and check the option "Loot everything"
3. Put one legendary into your bag
4. Continue botting and at some point try to throw the legendary in bag to ground. See if the character picks this up.

When choosing "Loot everything", it should loot everything regardless of whether the item is legendary or not. We try to determine whether the bot cannot determine whether an item is legendary or it cannot detect an item when it's a legendary.
